Electronic toll collection in the Slovak Republic is governed by the legal regulations of the Slovak Republic and related legal acts of the European Union, which regulate, in particular, the conditions for toll collection, the scope of the charged road network, the method of calculating toll, toll rates, discounts, and the interoperability rules for electronic road toll systems.

Legislation of the Slovak Republic

The basic legislative regulation in the field of electronic toll collection is Act No. 474/2013 Coll. on the collection of toll for the use of designated sections of roads and on amendments to certain acts, as amended (hereinafter the “Toll Collection Act”), which, under Section 1, regulates, in particular:

  • the conditions for electronic toll collection and substitute toll collection for the use of designated sections of motorways, expressways, class I roads, class II roads and class III roads,
  • the rights and obligations of the vehicle operator, the vehicle driver, the Toll Collection Administrator, a person authorised by the Toll Collection Administrator, the provider of the European Electronic Toll Service, and the notified body,
  • the conditions for providing the European Electronic Toll Service and the conciliation procedure in the area of the European Electronic Toll Service,
  • the procedure for authorisation and notification,
  • the exercise of control over compliance with the Toll Collection Act,
  • the competence of state administration authorities,
  • liability for breach of obligations laid down by the Toll Collection Act and special regulations.

(Note: Under the applicable Decree No. 228/2020 Coll. of the Ministry of Transport and Construction of the Slovak Republic, the designated road sections are the sections of motorways, class I roads and class II roads. Class III roads are not currently part of the network of designated road sections in the Slovak Republic.)

The related legal regulations and implementing legislation of a sub-statutory nature in the field of electronic toll collection are represented, in particular, by:

  • Decree No. 476/2013 Coll. of the Ministry of Transport, Construction and Regional Development of the Slovak Republic, implementing certain provisions of the Toll Collection Act and amending certain acts, as amended (hereinafter the “Implementing Decree to the Toll Collection Act”),
  • Decree No. 228/2020 Coll. of the Ministry of Transport and Construction of the Slovak Republic, designating the sections of motorways, class I roads and class II roads subject to toll collection, as amended (hereinafter the “Decree on Designated Road Sections”),
  • Government Regulation No. 418/2024 Coll. of the Slovak Republic, laying down the method of calculating toll, toll rates, the method of determining a vehicle's emission class and the system of discounts on toll rates, as amended (hereinafter the “Government Regulation on Toll Calculation, Toll Rates and Discounts”).

Legislation of the European Union

Legal acts of the European Union in the field of electronic toll collection, interoperability of electronic road toll systems, cross-border exchange of information on unpaid road tolls, and related toll calculation parameters are represented, in particular, by:

  • Directive 1999/62/EC of the European Parliament and of the Council of 17 June 1999 on the charging of heavy goods vehicles for the use of certain infrastructures, as amended (hereinafter “Directive 1999/62/EC”),
  • Directive (EU) 2019/520 of the European Parliament and of the Council of 19 March 2019 on the interoperability of electronic road toll systems and facilitating cross-border exchange of information on the failure to pay road fees in the Union – recast (hereinafter “Directive (EU) 2019/520”),
  • Directive (EU) 2022/362 of the European Parliament and of the Council of 24 February 2022 amending Directives 1999/62/EC, 1999/37/EC and (EU) 2019/520, as regards the charging of vehicles for the use of certain infrastructures (hereinafter “Directive (EU) 2022/362”),
  • Regulation (EU) 2019/1242 of the European Parliament and of the Council of 20 June 2019 setting CO₂ emission performance standards for new heavy-duty vehicles and amending Regulations (EC) No 595/2009 and (EU) 2018/956 of the European Parliament and of the Council and Council Directive 96/53/EC, as amended (hereinafter “Regulation (EU) 2019/1242”),
  • Commission Delegated Regulation (EU) 2020/203 of 28 November 2019 on classification of vehicles, obligations of European Electronic Toll Service users, requirements for interoperability constituents and minimum eligibility criteria for notified bodies (hereinafter “Delegated Regulation (EU) 2020/203”),
  • Commission Implementing Regulation (EU) 2020/204 of 28 November 2019 on detailed obligations of European Electronic Toll Service providers, minimum content of the European Electronic Toll Service domain statement, electronic interfaces, requirements for interoperability constituents and repealing Decision 2009/750/EC (hereinafter “Implementing Regulation (EU) 2020/204”).
