Vehicles subject to the toll payment obligation

Under Section 2(2) of the Toll Collection Act, the obligation to pay toll for the use of designated road sections applies to:

• motor vehicles with a maximum technically permissible total weight exceeding 3,500 kg, or
• combinations of vehicles with a maximum technically permissible total weight exceeding 3,500 kg.

The toll payment obligation does not apply to category M1 motor vehicles or to combinations of vehicles consisting of a category M1 or N1 motor vehicle and a category O1 or O2 trailer.

Before driving on designated road sections, a vehicle subject to the toll payment obligation must be registered in the electronic toll system and equipped with an on-board unit assigned to that vehicle. The on-board unit must be correctly positioned, put into operation and set so that the data necessary for calculating toll correspond to the vehicle's data and its actual condition.

Vehicles exempt from toll payment

Under Section 3(1)(a) to (o) of the Toll Collection Act, the following vehicles are exempt from paying toll for the use of designated road sections:

1. vehicles of the Ministry of the Interior of the Slovak Republic and the Police Force,
2. vehicles of the Ministry of Defence of the Slovak Republic,
3. vehicles of the armed forces or civilian components of the sending state for the purpose of performing official duties,
4. vehicles of the armed forces of the Slovak Republic and the North Atlantic Treaty Organization,
5. vehicles of rescue components of the integrated rescue system, except for legal entities and natural persons whose subject of activity is the provision of assistance in protecting life, health and property under a special regulation,
6. vehicles of foreign rescue components participating, at the request of state authorities,
   1. of the Slovak Republic in rescue operations during emergencies or participating in preparation for civil protection in the territory of the Slovak Republic,
   2. of another state in rescue operations during emergencies, in humanitarian aid, or participating in preparation for civil protection outside the territory of the Slovak Republic,
7. vehicles of the Toll Collection Administrator,
8. vehicles carrying out maintenance of designated road sections,
9. vehicles used to carry out toll collection control by persons authorised to carry out toll collection control,
10. vehicles of the Slovak Information Service,
11. vehicles of the Corps of Prison and Court Guard,
12. vehicles of the financial administration,
13. vehicles of the State Material Reserves Administration of the Slovak Republic when performing tasks under a special regulation,
14. vehicles of the National Bank of Slovakia carrying out the transport of money and other valuables,
15. historic vehicles.

The conditions for applying toll exemption for individual vehicle categories, related registration obligations and special rules for vehicles exempt from toll payment are regulated in more detail, in particular, in Sections 3 and 10 of the Toll Collection Act and in related special regulations.

The Toll Collection Act, in Section 3(2) to (4), also lays down the special rules set out below for applying toll exemption. These rules mainly concern the registration of selected vehicles exempt from toll payment under Section 10 and the consequences of their non-registration under Section 9 of this Act, as well as vehicles carrying out maintenance of designated road sections and towed vehicles:

• For vehicles under Section 3(1)(c), (e) to (i), (m) and (o) of the Toll Collection Act, the toll exemption applies only if these vehicles are registered in the electronic toll system as vehicles exempt from toll payment before driving on designated road sections. If these vehicles are not registered in this way, the vehicle operator and vehicle driver are subject to the same obligations as in the case of vehicles subject to the toll payment obligation, in particular the obligation to register the vehicle, to equip the vehicle with an on-board unit and to use it, and to pay toll.
• For vehicles under Section 3(1)(h) of the Toll Collection Act carrying out maintenance of designated road sections, under Section 3(3) of this Act, the toll exemption applies only to those designated road sections on which these vehicles carry out maintenance.
• Under Section 3(4) of the Toll Collection Act, a towed vehicle is not subject to toll payment. However, if the on-board unit assigned to the towed vehicle is switched on during towing, toll is charged for that vehicle. Before towing or transporting an immobile vehicle, it is therefore necessary to switch off the on-board unit assigned to that vehicle or to set the mode intended for the transport or towing of the vehicle in accordance with the instructions for using the on-board unit.
